When an individual provides their details to The Fotheringham Gallery in the gallery, at an art fair, when purchasing from the Fotheringham Gallery website or via join the mailing list link link on the Fotheringham Gallery website, they have opted in to receive further details about future Fotheringham Gallery exhibitions and art fairs. If this is the case, and that individual decides they no longer want to be on The Fotheringham Gallery’s mailing list/s, they can be unsubscribed or be removed easily by:

Log files.
We use Google Analytics to analyse anonymous user details from our website which we can then use to make changes to the site’s layout to improve the user experience. Log files do not contain any personal information and cannot access a user’s computer.
Any personal information held by The Fotheringham Gallery is stored and processed under the company’s Data Protection Policy, in line with the Data Protection Act 1998.

Availability
We keep our website up to date daily. All purchases are subject to current availability and authorisation of payment. In the unlikely event that an artwork has been sold in the gallery prior to an online purchase, the customer will be informed and payment refunded.
Whilst we attempt to be as accurate as possible with the specifications of the artwork offered for sale, we cannot be held responsible for any inaccuracies.
Please note that all pieces have been photographed to the best of our ability and colours may vary slightly.
Delivery
Most paintings and all jewellery are free delivery within the UK. Paintings are delivered by the most suitable tracked courier, small paintings by the Post Office and jewellery by Special Delivery which is insured to the value of the piece. We do not accept online orders from out with the UK. If a painting is large or of high value and therefore requiring additional insurance we will arrange a specialist art courier which will incur a delivery cost. These pieces will not be available to buy directly from our online shop but please phone or contact us if you would like to arrange to purchase and we can advise the most suitable delivery method and cost.
We endeavour to post out work within a day or two of receiving the order depending on how much time is required to package the artwork safely. This will however vary depending on weekends and bank holidays and we will keep the purchaser informed of expected delivery times.
We have a great reputation for packaging and delivering paintings and other artworks safely and quickly. We have successfully posted many pieces over the years and you can read the testimonials from satisfied customers here.
If you live outside the UK and are interested in buying something from our website please contact the gallery and we will advise you if it will be possible.
All work is sent DDU (Delivery Duties Unpaid) and the buyer will be liable for these costs. In the unlikely event of loss or damage during transit, subject to proof of loss or damage, we shall refund the cost of the piece, minus any postage costs.
Refunds
If you are not entirely satisfied with your purchase for any reason, you can return the artwork for a full refund, minus any postage costs. Returns must be informed within 7 days of receipt and the cost of return carriage must be borne by the purchaser. The artwork must be returned in perfect condition and in the original packaging.
All disputes will be settled under Scottish Law.
Copyright for the images shown on our website remains with the artist and further distribution of the images in whatever format may be the subject of Legal proceedings.
